1. General

Welcome to Simonetta Wang Ltd, a company registered in the United Kingdom ("we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of our official website www.simonettawang.com ("the Website"), as well as all semi-custom made-to-order garment services and related services provided by us (collectively, "the Service").
By accessing the Website, placing an order, or using the Service, you acknowledge that you have read, understood and agree to be bound by these Terms, together with our Privacy Policy, Refund Policy and Shipping Policy. If you do not agree to these Terms, please do not use the Service.

2. Eligibility

To use the Service and place an order, you must be at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into a binding contract. You represent and warrant that all information you provide is true, accurate and complete.

3. Orders & Semi-Custom Rules

3.1 We provide semi-custom made-to-order services: our established garment designs are adjusted in pattern according to the body measurements you provide yourself, to achieve a better fit. We do not offer in-person measuring services. You are required to take your own measurements following our official measurement guide and submit the data accordingly.

3.2 Our service only includes size adjustment. We do not offer design structural changes, fabric substitutions, or added decorative modifications.

3.3 Submitting an order and paying the deposit constitutes a binding offer to purchase. All orders are subject to our acceptance. We reserve the right to refuse or cancel any order for reasons including but not limited to: fabric unavailability, pricing or description errors, suspected fraudulent activity, or failure to meet order requirements.

3.4 Upon successful deposit payment, we will send an order confirmation email. The contract between you and us is formed when the 15-day deposit cooling-off period expires and your final measurements are confirmed, at which point production commences.

4. Payment Terms

4.1 All semi-custom orders follow a 50% deposit + 50% balance payment structure. We accept major credit cards, debit cards and other secure payment methods displayed at checkout.

4.2 Deposit: A 50% deposit of the total order value is required at checkout to secure your order. The deposit is fully refundable within the 15-day cooling-off period. After the cooling-off period, the deposit is allocated to production preparation and is non-refundable.

4.3 Balance: When your garment is completed, we will notify you via email to pay the remaining 50% balance. A 15-day balance cooling-off period applies after payment, during which shipment will not be arranged. You may request a refund of the balance within this period (the deposit remains non-refundable). Shipment will be arranged once the cooling-off period expires with no objection.

4.4 All prices on the Website are quoted in British Pounds (GBP). Prices are subject to change without notice, but once your order is accepted, the price confirmed at checkout will be honoured.

4.5 All payments are processed directly by Stripe, a PCI DSS compliant third-party payment provider. We do not store full card details on our servers.

5. Production & Delivery

5.1 The standard production lead time for semi-custom garments is 60 calendar days, calculated from the date the deposit cooling-off period ends and your measurements are final confirmed. Styles with complex handcrafting may require a longer lead time, which we will advise you of in advance.

5.2 In the event of fabric shortages, supply chain disruptions, force majeure or other unforeseen circumstances causing delay, we will notify you in advance and adjust the delivery timeline accordingly.

5.3 Upon production completion and receipt of the balance payment, your order will be shipped via international logistics. Full details of shipping methods, timelines and lost/damaged parcel handling are set out in our Shipping Policy.

6. Cancellations & Quality

6.1 Cancellation Policy: Under the UK Consumer Contracts Regulations, personalised made-to-order goods are exempt from the statutory 14-day cooling-off right for distance selling. We voluntarily offer a 15-day deposit cooling-off cancellation period, as detailed in our Refund Policy.

6.2 Definition of Manufacturing Defect: Every garment undergoes strict quality control before dispatch. A manufacturing defect is strictly defined as a structural error resulting from craftsmanship failure, including: major unsewn seams affecting structural integrity, inherent fabric damage, or significant construction deviation from the confirmed specifications.

6.3 The following are NOT considered manufacturing defects:
  • A size tolerance within ±2 cm, which is within the normal range for handcrafted custom garments
  • Minor colour variations between fabric batches, or colour perception differences due to monitor display settings
  • Minor loose threads that do not affect wearability
  • Fit issues caused by self-measurement errors, incorrect size submission, body changes, or personal wearing preferences
  • Damage caused during international transportation

6.4 Quality claims must be submitted within 30 calendar days of delivery, with clear photos/videos as evidence. We will review the claim within 5 business days and provide a resolution. Full terms are set out in our Refund Policy.

7. Import Duties & Taxes

Prices on the Website include the cost of the garment and standard international shipping. They do not include import duties, value-added tax (VAT), customs clearance fees or any other local taxes and fees imposed by the destination country/region. All import-related charges are the sole responsibility of the recipient.

If the recipient refuses to pay applicable duties and taxes, resulting in the garment being returned, held or destroyed by customs, all associated losses shall be borne by you, and neither the deposit nor the balance will be refunded.

8. Intellectual Property

8.1 All intellectual property rights in the Website, garment designs, patterns, brand marks, trademarks, imagery, text and all other content are owned by Simonetta Wang Ltd. You may not copy, distribute, modify, commercially use or otherwise exploit any of the above without our prior written permission.

8.2 Your body measurements and personal information will only be used to fulfil your order, in accordance with our Privacy Policy, and will not be used for other commercial purposes.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, consequential or punitive damages (including loss of profit, loss of reputation) arising from your use of the Service or products purchased, except in cases of our gross negligence or wilful misconduct.

We shall not be liable for: delivery delays caused by force majeure; issues caused by incorrect information provided by you; damage or delay caused by third-party logistics carriers; damage caused by unauthorised alterations or improper care.

10. Force Majeure

We shall not be liable for any delay or failure to perform our obligations under these Terms due to force majeure events beyond our reasonable control, including but not limited to natural disasters, war, civil unrest, supply chain disruptions and government regulations. We will notify you as soon as reasonably possible and use reasonable efforts to minimise the impact.

11. Changes to These Terms

We may update these Terms from time to time to reflect operational changes or regulatory requirements. The revised Terms will be posted on this page with an updated "Last Updated" date. Your continued use of the Service after the changes are posted constitutes acceptance of the updated Terms. For material changes, we will provide advance notice via prominent website notice or email.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales.

Any dispute arising from these Terms or the Service shall first be resolved through good-faith negotiation. If negotiation fails, the courts of England and Wales shall have exclusive jurisdiction. Nothing in this clause shall affect your statutory rights as a consumer in your country of residence, or your right to lodge a complaint with your local supervisory authority.

13. Miscellaneous

13.1 These Terms, together with our Privacy Policy, Refund Policy and Shipping Policy, constitute the entire agreement between you and us, and supersede all prior oral or written agreements.

13.2 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
